Terms for buying a domain name

1.1 These terms apply when you buy a domain name offered for sale via ZETA. ZETA is a trade name of Zeta Datacenters B.V., established in the Netherlands.

1.2 We provide the sales page, the secure payment and the transfer of the domain name.

1.3 For domains already managed by ZETA, ZETA acts as the seller and transfers the domain to you itself after payment.

1.4 For third-party domains, the domain name belongs to a ZETA customer or partner. ZETA then acts as an intermediary and payment agent: we bring buyer and seller together, hold your payment securely and arrange the transfer. The purchase agreement is concluded between you and the owner; ZETA has a best-efforts obligation here, not an obligation to achieve a specific result.

2.1 The purchase is concluded subject to the condition precedent of a successful transfer of ownership. Your payment only becomes final once the domain name is registered in your name.

2.3 This full refund is your sole and complete remedy if a transfer does not proceed. You cannot enforce performance (forced delivery) and there is no right to any further compensation or consequential damages.

3.1 You can pay with the methods shown on the payment page (including Wero, credit card and bank transfer), or via Escrow.com for third-party domains.

3.2 Your payment is held securely and only paid out to the seller after the transfer.

3.3 A refund is processed via the original payment method. Depending on your bank, this may take a few business days.

4.1 Once your payment is secured, we transfer the domain name to you.

4.2 For a ZETA domain this is usually done directly via a change of registrant. For a third-party domain you receive the details (for example a transfer code) to put the domain in your name.

4.3 We make every effort to complete the transfer as quickly as possible.

5.1 If you buy as a business or in a professional capacity, the NLdigital Terms apply to our services, supplemented by these domain-sale terms.

5.2 In case of conflict, these domain-sale terms prevail with regard to the purchase and transfer of the domain name.

5.3 Our liability is limited as set out in the NLdigital Terms; in all cases our liability is at most equal to the amount you paid, and liability for indirect or consequential damages is excluded.

6.1 If you buy as a consumer (not acting in the exercise of a profession or business), the NLdigital Terms do not apply and you have statutory consumer protection. In principle, for a distance purchase you have a 14-day cooling-off period.

6.3 As long as the transfer has not taken place and your cooling-off period is running, you can cancel the purchase free of charge and receive a refund.

7.1 Our liability is limited to the amount you paid for the domain name in question.

7.2 Liability for indirect damages, consequential damages or lost profits is excluded, to the extent permitted by law.

7.3 This limitation does not apply in the event of intent or deliberate recklessness on the part of ZETA, and does not affect mandatory consumer rights.

8.1 We handle your data carefully and use it only to process the purchase, payment and transfer.

9.1 These terms and the purchase are governed by Dutch law.

9.2 Disputes are submitted to the competent Dutch court, unless the law mandatorily designates a different court.
